Law firm marketing strategy checklist, from first line to sign-off
law firm marketing strategy checklist covers authority, claims, confidentiality, vendors, accessibility, intake, capacity, economics, evidence, and approvals.
What to take away
- Use the checklist at briefing, approval, launch, and review.
- Do not place real client details into marketing workflows by default.
- Vendor access and conduct need defined limits and supervision.
A law firm marketing strategy checklist should document judgment, not replace it. Apply this control list to the strategy and to each campaign, asset, vendor, automation, and material revision. A lawyer familiar with the relevant facts and jurisdictions should resolve uncertain professional issues.
Run the checklist from first line to sign-off
Drafting the first line of copy is a control gate, not the last step. Work the sequence, and record a result at each step.
- First line and every claim.Draft the headline, body copy, and call to action against ABA Model Rules of Professional Conduct 7.1 through 7.5, which most states have adopted as their own rules of professional conduct.
- State bar advertising rules.Check the advertising rules of each state you target for required labels, disclaimers, disclaimer placement, and any pre-filing or approval requirement. New York, for example, requires advertisements to be labeled "Attorney Advertising" at the top of the first page.
- Testimonials and results.Get written client consent for each testimonial, keep the statement from being misleading, and add a disclaimer that prior results do not guarantee a similar outcome.
- Solicitation and referrals.Review direct solicitation against Model Rule 7.3, and review fee-sharing and referral arrangements against Rule 1.5(e).
- Email, calls, and texts.Confirm consent, opt-out, and sender identification under the CAN-SPAM Act and the Telephone Consumer Protection Act before a campaign sends.
- Personal information.Check intake forms, analytics, and retargeting audiences against the California Consumer Privacy Act and the privacy law of each state you market in.
- Approval and sign-off.Name the reviewing lawyer, the evidence, the jurisdictions, the version, and the approval date, then set the next review date and the change that would trigger an earlier one.
A step that cannot be evidenced is a step that is not finished.
Approve twelve control areas
| Area | Approval question |
|---|---|
| Authority | Which current rules, opinions, laws, and platform duties apply? |
| Audience | Who is included, excluded, vulnerable, or in urgent need? |
| Service | Can the firm competently and promptly handle resulting matters? |
| Claims | What evidence supports the words and net impression? |
| Identity | Are lawyers, firm, sponsorship, and responsibility clear? |
| Contact | Is the route safe, accessible, and appropriately labeled? |
| Intake | Are screening, conflicts, expectations, and handoffs tested? |
| Data | Is collection limited, protected, retained, and deleted properly? |
| Vendor | Are instructions, access, review, audit, and exit defined? |
| Economics | Does full cost fit capacity and contribution? |
| Measurement | Are events, denominators, limits, and decisions defined? |
| Records | Can the firm reproduce approval and the published version? |
Cornell's Legal Information Institute explains an attorney's duty of confidentiality as an ethical duty concerning information related to representation and distinguishes it from privilege. A marketing data plan still needs review under governing rules and other applicable law. Firms that map these duties into vendor controls often start with a legal marketing compliance review.
Control people outside the legal team
Cornell's Legal Information Institute publishes Pennsylvania Rule of Professional Conduct 5.3 on responsibilities concerning nonlawyer assistants. Firms governed elsewhere should verify their own authority and translate applicable duties into vendor and staff controls rather than relying on a contract label.
- Record reviewer, evidence, jurisdiction, version, and approval date
- Test claims after cropping, snippets, voiceover, and platform formatting
- Use fictional or properly approved examples with accurate context
- Restrict access to intake and analytics systems by role
- Sample calls, forms, messages, referrals, and declined matters
- Set immediate pause rules for misleading content or data incidents
At launch, capture the exact creative, landing route, audience settings, forms, scripts, vendor configuration, and tracking definitions. At closure, remove stale placements, revoke access, export required evidence, honor retention rules, reconcile outstanding contacts, and record the decision.
Record the gate result
The W3C Privacy Principles statement gives web-system designers shared privacy concepts and warns against shifting privacy work to individuals. Treat that as design guidance rather than marketing approval: the state privacy law and the advertising rules that apply to your firm still control the review.
The CISA software acquisition fact sheet covers development practice, supply-chain exposure, deployment, and vulnerability management. Add those government-acquisition questions to a vendor review without treating them as local approval; the state bar advertising rules and the ABA Model Rules of Professional Conduct still govern the marketing itself.
Log every checklist item: pass, fail, not applicable, accepted exception. Add evidence location, reviewer, decision date, next review; unproven checked boxes cannot protect releases. Keep the log for the retention period your state bar and malpractice insurer require, and note that period in the record itself.
Stop work if a mandatory privacy, security, data-quality, accessibility, or correction condition fails, even if remaining score looks favorable.
A law firm marketing strategy mistakes review often finds the same gaps in evidence records and exception handling.
Keep the evidence record beside the decision so a reviewer can reproduce the reasoning without memory. Set the next review date and name the change that would trigger an earlier check.
Record rejected options as well as the chosen path, because the original constraint may change later. Use the same definitions in the interface, export, meeting note, and correction log.
Common questions
Can one checklist cover every state?
It can organize work, but it cannot replace jurisdiction-specific authority and fact-specific review.
Should marketers see client files?
Only when a defined, approved purpose and access rule requires it; aggregate or minimized evidence is often enough.
When is reapproval needed?
Reapprove after material changes to claims, creative, targeting, channel, vendor, service, lawyer, jurisdiction, or evidence.
